Terms of Service

1. Acceptance of Terms
By accessing and using the services provided by FireFun Games (“we,” “our,” or “us”), you accept and agree to be bound by the terms and provision of this agreement.
2. Services
FireFun Games provides specialized software development services with deep expertise in:
Game Development
- Unity 3D game development for mobile, desktop, and web platforms
- Educational games and interactive simulations
- Multiplayer systems integration (Photon, custom networking)
- Physics-based gameplay mechanics and simulations
- Game porting and optimization across platforms
- AR/VR applications and interactive experiences
Backend Development
- ASP.NET Core and Node.js backend systems
- Azure cloud infrastructure and DevOps
- RESTful API design and implementation
- Database design (SQL Server, CosmosDB, Pinecone)
- AI integration and conversational agents
- HIPAA-compliant healthcare applications
Web Development
- Next.js and React applications
- TypeScript development
- Responsive web design with Tailwind CSS
- Progressive web applications (PWAs)
- GDPR-compliant web solutions
Specialized Services
- Legacy code refactoring and modernization
- Performance optimization and debugging
- Technical architecture consulting
- Code review and quality assurance
- Team leadership and mentoring
- Educational content and programming tutorials
3. Project Agreements
Each project will be governed by a separate written agreement that will include:
- Detailed scope of work and deliverables
- Timeline and milestones
- Payment terms and schedule
- Intellectual property rights
- Confidentiality provisions
- Acceptance criteria
4. Payment Terms
Hourly Projects
- Invoices are sent weekly or monthly as agreed
- Payment due within 15 days of invoice date
- Late payments may incur a 1.5% monthly service charge
Fixed-Price Projects
- Payment schedule based on project milestones
- Typically 25-50% deposit required to begin work
- Final payment due upon project completion and acceptance
5. Intellectual Property
Client Ownership
Upon full payment, all custom code and assets developed specifically for your project will be transferred to you, unless otherwise agreed in writing.
Pre-existing Assets
Any pre-existing code, tools, libraries, or methodologies used in your project remain the property of FireFun Games and may be used in future projects.
Third-Party Components
Projects may include third-party libraries or assets subject to their own licenses. You are responsible for compliance with such licenses.
6. Confidentiality
We maintain strict confidentiality regarding all client information and project details. We will not disclose any confidential information without your express written consent, except as required by law.
7. Warranties and Disclaimers
Quality Assurance
We warrant that all work will be performed in a professional manner and will substantially conform to the agreed specifications.
Limitation of Warranties
Except as expressly stated, all services are provided “as is” without warranties of any kind, either express or implied, including but not limited to merchantability or fitness for a particular purpose.
8. Limitation of Liability
In no event shall FireFun Games be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption, arising from the use of our services.
Our total liability for any claim related to our services shall not exceed the total amount paid by you for the specific services giving rise to the claim.
9. Project Changes and Scope Creep
- Changes to project scope must be agreed upon in writing
- Additional work outside the original scope will be billed separately
- Change requests may affect project timeline and cost
- Minor clarifications and bug fixes within scope are included
10. Termination
By Client
You may terminate services at any time with written notice. You will be responsible for payment of all work completed up to the termination date.
By FireFun Games
We may terminate services with 30 days written notice, or immediately in case of non-payment or breach of these terms.
11. Support and Maintenance
Included Support (30 Days)
- Bug fixes related to delivered functionality
- Minor clarifications and documentation updates
- Assistance with deployment and setup issues
- Response time: 24-48 hours during business days (Denmark timezone)
Extended Support Services
- Ongoing maintenance contracts available
- New feature development and enhancements
- Performance monitoring and optimization
- Security updates and dependency management
- 24/7 critical issue support (for mission-critical applications)
Exclusions
- Third-party service outages or API changes
- Issues caused by client modifications to delivered code
- Infrastructure or hosting-related problems
- Training or user education beyond initial handover
12. Force Majeure
Neither party shall be liable for any delay or failure to perform due to circumstances beyond their reasonable control, including but not limited to acts of God, war, terrorism, pandemic, or government regulations.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of Denmark. Any disputes shall be resolved through binding arbitration or in the courts of Denmark.
14. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on our website and will take effect immediately upon posting. Continued use of our services constitutes acceptance of the modified terms.
